What the rules say about Denmark

The rules below are the ones most likely to shape a stay in Denmark, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueTax residency

A continuous stay of at least 6 months triggers full liability retroactive to day one

Under Kildeskatteloven section 1(1)(2), full Danish tax liability arises where an uninterrupted stay reaches at least 6 continuous calendar months, with or without a Danish home. Because calendar months vary in length, that boundary can be as few as 181 days depending on which months the stay spans, not a flat 183-day count. Short holiday absences do not break the chain. Liability is retroactive to the first day of the stay, not to month six, and this is a continuous block, not an aggregate like the 180-day Schengen count.

  2. Significant issuePersonal income tax

No tax treaty with Spain means no Article 15 relief and no MAP

Denmark unilaterally terminated its tax treaty with Spain effective 1 January 2009 over pension taxing rights, and as of September 2026 no replacement exists or is in prospect. A Spanish resident working temporarily in Denmark, or a Dane retiring to Spain, has no treaty tie-breaker and no mutual agreement procedure, only whatever unilateral credit each country's domestic law allows.

  3. Significant issueImmigration and visa

No digital nomad visa exists, and none is announced

Denmark has no digital nomad visa, no investor route and no passive-income route. Denmark's opt-out from EU Justice and Home Affairs also means the EU Blue Card, the Single Permit Directive and the ICT Directive do not apply here, so every third-country route runs on purely national rules tied to an employer or an approved business.

  4. Significant issueCrypto tax and legal status

Losses relieve at only about 26 percent and do not offset gains

Gains and losses go into separate boxes on the Danish tax return and do not net against each other. Gains are taxed as personal income at up to about 52 percent, but losses relieve only as a ligningsmaessigt fradrag, a deduction worth about 26 percent, at the bottom of the income stack. The Danish Supreme Court confirmed this asymmetry in June 2025, it is settled law. In a volatile year with heavy trading you can owe substantial Danish tax while being flat or down overall.

  5. Significant issueMoving your company

Running your foreign company from a Copenhagen home office can make it Danish

A company is Danish tax resident if its actual place of management is in Denmark, meaning where day-to-day management decisions are made, even if it stays incorporated abroad. A founder who relocates personally and keeps running their foreign company from a Danish home office risks dragging that company into Danish corporate tax residence on its worldwide profits, without ever formally moving it.

  6. Needs checkingResidency routes

No golden visa, no investor route, no passive-income route

Denmark has no golden visa, no investor residence, no citizenship by investment and no passive-income or retiree route. Every third-country route into Denmark is employment-based or entrepreneur-based, so a self-funded non-working relocator with no Danish job offer and no EU, EEA or Nordic passport has essentially no route in. EU, EEA and Nordic nationals are unaffected, treaty free movement already gives them the right to reside as a self-sufficient person with no investor route needed.
