What the rules say about Dominican Republic
The rules below are the ones most likely to shape a stay in Dominican Republic, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issuePersonal income tax
Codigo Tributario Article 271: your foreign investment income is only tax-free for your first two years as a resident
Article 271 of the Codigo Tributario reads, in the original legal text: 'Las personas naturales nacionales o extranjeras que pasen a residir en la Republica Dominicana, solo estaran sujetas al impuesto sobre sus rentas de fuente extranjera, a partir del tercer ano o periodo gravable a contar de aquel en que se constituyeron en residentes.' In plain terms, someone who becomes a resident is only taxed on their foreign-source income starting from the third year or taxable period after becoming resident, which means the first two years are exempt and year three onward is not. This is the mechanism behind the widely repeated claim that the Dominican Republic is simply territorial, which is only true for your first two years as a resident.
- Significant issueImmigration and visa
Past 60 days you are outside any confirmed tourist entry and need a residency route
Sixty days is the outer legal ceiling this research could confirm for a Dominican tourist entry under Ley 285-04 Article 40. Beyond that, staying without a residency permit is not a grey area, it is unauthorized presence, and Dominican immigration does enforce exit fines for overstays. A stay this long calls for either the pensionado or rentista route under Ley 171-07, the investor route, or a standard temporary residence permit arranged before you cross the line, not after.
- Significant issuePermanent establishment risk
A Dominican company actually run from a Dutch kitchen table can end up claimed by both countries, with no treaty to sort it out
Codigo Tributario Title I, Article 12(e) sets three independent tests for a company being domiciled in the Dominican Republic: incorporation under Dominican law, having its principal place of business there, or having its effective management (direccion efectiva) there. Any one of the three is enough, so a company incorporated in the Dominican Republic stays Dominican-domiciled under the incorporation test alone, regardless of where it is actually run from. Meanwhile, the Netherlands applies its own effective-management test for Dutch corporate tax residency, and if the real decisions are made from a Dutch kitchen table, the Netherlands can independently claim the same company as a Dutch tax resident. Because no tax treaty exists between the two countries, there is no tie-breaker article to resolve a dual claim, unlike in most of this platform's other corridors.
- Significant issueTax residency
There is no tax treaty tie-breaker if both the Netherlands and the Dominican Republic claim you as resident
No double taxation treaty exists between the Netherlands and the Dominican Republic (confirmed against the Dutch government's own treaty registry). Most treaties include a tie-breaker article that decides which country wins when two countries' domestic tests both claim someone as a tax resident. Without a treaty, that mechanism simply does not exist here. If you meet both the Dutch and Dominican residency tests at the same time, there is no formal referee, only whatever each country's domestic law and any unilateral relief it offers says on its own.
- Significant issueSocial security
No Netherlands-Dominican Republic social security agreement exists, so continuity is entirely on the Dutch side to arrange
This research found no bilateral social security or totalization agreement between the Netherlands and the Dominican Republic. Ley 87-01 itself only says the Dominican system 'podra establecer convenios de proteccion reciproca' with other countries, an enabling power the law describes as available, not evidence it has actually been used for the Netherlands. Without an agreement, there is no automatic mechanism to combine contribution years across the two systems, and whether your Dutch AOW pension accrual, WW unemployment insurance or other coverage continues while you are in the Dominican Republic depends entirely on Dutch domestic rules for people living outside the Netherlands and outside a treaty country, not on anything the Dominican Republic offers.
- Significant issueMoving your company
The 1 percent tax on company assets was supposed to disappear in 2016, it never actually did
Codigo Tributario Title V, Article 401, carries a note stating that under Ley 253-12, the asset tax rate would fall from 1 percent to 0.5 percent from 2015 and be eliminated entirely from fiscal year 2016. Read only that note, and you would conclude the tax is gone. Read the very next paragraph, Paragrafo I, and the reduction was only ever conditional on the country hitting a specific tax-pressure target set out in the 2012 National Development Strategy law, a target the Dominican Republic has not reached. DGII's own current published guidance and multiple independent 2026 tax references confirm the 1 percent rate is still being collected today, filed alongside the annual corporate income tax return. Companies with no income tax liability are exempt from it.
