What the rules say about Gibraltar

The rules below are the ones most likely to shape a stay in Gibraltar, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueTax residency

A Spanish national relocating to Gibraltar from Spain stays Spanish tax resident permanently

Under the 2019 International Agreement on Taxation between Gibraltar and Spain, a Spanish national who moves from Spain to Gibraltar after 4 March 2019 stays Spanish tax resident for as long as they live in Gibraltar, permanently. This is not a temporary tail, it does not expire after a fixed number of years, and it is the single biggest individual-level trap on the whole Gibraltar board for anyone holding Spanish nationality who is actually relocating out of Spain. The Income Tax Office's own FAQ confirms this rule does not reach a Spanish national moving to Gibraltar from somewhere other than Spain, applying it to someone who has already lost Spanish tax residency elsewhere would go against the spirit and context of the Treaty, since Spain does not charge tax on the basis of nationality alone. The rule also cannot be inherited by a child born in Gibraltar. Gibraltar's own low-tax regime is close to irrelevant if Spain continues to treat you as fully resident.

  2. Significant issueMoving your company

A new Gibraltar company controlled or managed from Spain is deemed resident only in Spain

Under Article 2(2)(a) of the 2019 Spain International Tax Agreement, a Gibraltar company is tax resident only in Spain if the majority of its assets sit in Spain, or the majority of its income derives from Spanish sources, or the majority of the individuals in charge of its effective management are Spanish tax resident, or 51 percent or more of its capital, equity, voting or profit-sharing rights are directly or indirectly controlled by Spanish tax residents or entities linked to them, with the 51 percent test applying through an entire ownership chain. These rules apply to every company incorporated in Gibraltar after 16 November 2018, with no exceptions. A narrow safeguard exists only for companies incorporated before 16 November 2018 that were caught solely by the management or control limbs and met five detailed substance conditions as at 31 December 2018, but that door is closed to any new structure.

  3. Significant issueImmigration and visa

Gibraltar has no digital nomad visa, and none is announced

Gibraltar has never had a digital nomad visa, and the 2025 to 2026 policy direction is the opposite of opening one, it is tightening. There is also no golden visa, no citizenship by investment and no retiree or passive-income visa of any kind. A third-country national planning a long remote-work stay without a Gibraltar employer, an approved business or a qualifying residence route has no legal path past the 90 day Schengen-style entry ceiling.

  4. Significant issueRight to work

The real trap for a Gibraltar worker is not Gibraltar, it is Spain

Gibraltar is 6.8 square kilometres with roughly 15,500 daily frontier workers crossing from Spain. The overwhelming majority of people who work in Gibraltar actually sleep in Spain, and the moment they do, Spanish residence rules and the 2019 International Agreement on Taxation take over, not Gibraltar's rules. Living in La Linea or Sotogrande and working in Gibraltar is a Spanish tax fact pattern, not a Gibraltar one, and it can pull you into full Spanish tax residence regardless of how little time you spend physically in Gibraltar.

  5. Significant issuePersonal income tax

Gibraltar has exactly two income tax agreements on earth, and yours is not one of them

Gibraltar's entire income tax treaty network is two agreements, the UK DTA (in force 24 March 2020, a full OECD-model treaty with tie-breakers and a mutual agreement procedure) and the Spain International Agreement on Taxation, which is an anti-abuse instrument, not a relief treaty. For 14 of the 16 NaVi roster nationalities, there is no treaty at all, no Article 15 employment relief, no Article 4 tie-breaker and no mutual agreement procedure with Gibraltar. Because Gibraltar taxes so little in the first place, the double-taxation risk usually sits on the home-state side, not the Gibraltar side, and the real exposure is your home country refusing to recognise the move, applying CFC rules, or applying an exit tax. Note also that Gibraltar limits DAC6 disclosure to Category D hallmarks generally, but for any arrangement involving Spain and Gibraltar, all DAC6 hallmarks A through E apply, a materially heavier disclosure load than a Gibraltar-only structure carries.

  6. Significant issueHealthcare coverage

Category 2 status buys no public healthcare and no public schooling, private insurance is required

The Government re-affirmed on 18 June 2026 that Category 2 status confers no entitlement to publicly funded schooling or healthcare. Category 2 applicants need private medical insurance as a practical condition of the status, this is described as the most commonly missed condition of the whole regime. This sits specifically alongside the Category 2 route, ordinary residents who are entitled under the Group Practice Medical Scheme's other categories are not affected by this exclusion.
