What the rules say about Poland

The rules below are the ones most likely to shape a stay in Poland, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueTax residency

Past 183 days you are a Polish tax resident on worldwide income

More than 183 days present in the tax year is the second, independent trigger for Polish tax residency (PIT Act Art. 3(1a)), counted with any part of a day as a full day, including arrival, departure, weekends and holidays. Once resident, Poland taxes your worldwide income at progressive rates of 12% to 32%, with a 4% solidarity levy on top above PLN 1,000,000.

  2. Significant issueMoving your company

Directing a foreign company from a Polish desk can make that whole company Polish tax resident

A company is Polish tax resident if either its registered office or its place of management and control sits in Poland, and management is judged broadly on where current activities are organised and continuously conducted. Separately, CFC rules tax a Polish resident at 19% on a foreign entity's attributed profits before distribution wherever ownership exceeds roughly 50% and passive income exceeds roughly 33% at a low-tax rate, with CFC income excluded from the ryczalt regime and pulled into the solidarity levy base.

  3. Needs checkingPersonal income tax

Treaty Article 15 relief needs all three conditions, not just the day count

Even under a tax treaty, employment income stays taxable only in your home state if you are present no more than 183 days in the relevant period, your employer is not a Polish resident, AND the cost is not borne by a Polish permanent establishment. Fail any single one of the three and Poland can tax you from day one, not day 184, and the 'economic employer' trap, where a Polish group entity directs or bears the cost of your work, is the most common way this fails.

  4. Needs checkingImmigration and visa

Third-country nationals outside the exempt list need a Schengen C visa before travel

Poland is in Schengen, so nationalities without visa-free access, Indonesia among the roster covered here, must obtain a Schengen short-stay (C) visa in advance rather than arranging anything on arrival. The visa itself is still capped by the same 90-day-in-180 Schengen rule as visa-free entry.

  5. Needs checkingResidency routes

Karta pobytu waits run 4 to 14 months, and the waiting stamp blocks travel

From 27 April 2026, residence-permit applications are filed exclusively online through the MOS portal using a Profil Zaufany, and the statutory 60-day deadline is almost never met because Border Guard security checks carry no fixed timeline. No voivodeship or UdSC page publishes official processing statistics, but practitioner-reported estimates put real 2026 waits at roughly 9-14 months in Warsaw down to 3-5 months in smaller voivodeships, treat that range as informed anecdote rather than a confirmed figure. The biggest trap is that the interim passport stamp legalising your stay is not a Schengen travel document, so you cannot safely leave and re-enter for the whole wait.

  6. Needs checkingRight to work

Remote work on a visa-free or visit visa status sits in a legal gray zone

Visa-free and Schengen C visa entry are granted for tourism or business visits, so working remotely for a foreign employer during that stay is technically not an authorized activity. It is widely practiced and enforcement is effectively nil, but no safe harbour or work-from-anywhere carve-out exists in Polish law.
