What the rules say about British Virgin Islands
The rules below are the ones most likely to shape a stay in British Virgin Islands, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueImmigration and visa
No digital nomad visa, no investor visa, no golden visa and no citizenship by investment exist
The BVI has no remote-work permit, no self-employment visa, no freelancer permit, no retiree or passive-income route and no investor visa with a published threshold. A BVI remote-work programme was publicised in 2021 but its current status could not be verified, so it should not be presented as available. A residency-for-investment policy exists but is bespoke, discretionary and Cabinet-level with no published price or entitlement, so it is not a programme in any normal sense.
- Significant issueRight to work
A visitor has no right to work in the BVI, full stop
There is no carve-out for local employment on visitor status. Employment in the Territory requires a work permit issued by the Department of Labour and Workforce Development, and carrying on business without the required trade licence is a separate offence under the Business, Professions and Trade Licences Act.
- Significant issueMoving your company
Claiming foreign tax residence to escape substance means the BVI tells that country, and tells the EU too
A company whose sole director sits at a desk in a roster country is, on that country's ordinary domestic test, tax resident there on worldwide profits, and the BVI has no treaty, so no Article 4 tie-breaker and no mutual agreement procedure exist to contest it. Escaping BVI economic substance by claiming non-resident-company status requires evidence such as a competent-authority certificate or tax assessment. Per ITA Rules 14.3 to 14.4, a notification of the claim is then sent to the competent authority of the jurisdiction claimed, and where a beneficial or legal owner is resident in an EU Member State, that Member State must also be notified that the entity is claiming tax residence outside the BVI, and given the name of the jurisdiction claimed. There is no fourth option: real BVI substance, a pure equity holdco, or claiming foreign residence and having the BVI tell that country and the EU.
- Significant issueEmployer payroll obligations
A second employer in the same year gets no USD 10,000 exemption at all
Where an individual is the employee of more than one employer in a financial year, the payroll tax base for the secondary and any subsequent employer is gross remuneration, the USD 10,000 exemption applies only to the primary employer. This directly catches consultants and portfolio workers with more than one BVI-connected income stream.
- Needs checkingLeaving home: exit tax and ties
The BVI charges nothing on the way out, but your home country's exit tax is systematically worse for this destination
The BVI has no net wealth tax, no capital gains tax, no inheritance tax, no gift tax and no exit tax of its own, there is literally nothing to exit from on this side. But most European exit-tax deferral and no-security reliefs are conditioned on the destination being EU/EEA, or having a mutual assistance agreement in the recovery of tax debts. The BVI has robust information exchange but generally no assistance in recovery, so deferral without security is typically unavailable. NL, DE, ES, FR, PL and others require security or accelerate payment for a non-EU/EEA, non-recovery-assistance destination like the BVI, GB's temporary non-residence rules claw back gains and certain income on return within 5 years, and US citizenship-based taxation means moving changes nothing federal short of formal expatriation under section 877A.
- Needs checkingSocial security
Social security runs 8.5 percent for private employees, split 4 percent employee and 4.5 percent employer
Private employees contribute 4 percent with the employer paying 4.5 percent, an 8.5 percent total on insurable earnings up to a ceiling of USD 51,000 for 2025, rising to USD 53,400 from 1 January 2026. Self-employed persons pay the full 8.5 percent themselves. Payment is due by the 14th of the following month, with a 5 percent penalty from the 15th. Where an individual has multiple employers and combined contributions exceed the maximum, the VISSB refunds the excess.
What tends to surprise people here
- No digital nomad, investor or golden visa exists
- Work permit holders cannot get a trade licence, so no lawful self-employment
- Missing the annual company fee now means immediate dissolution, not a grace period
