What the rules say about Brazil
The rules below are the ones most likely to shape a stay in Brazil, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueTax residency
No tax treaty means dual residency has no referee
Brazil has no double taxation treaty with this destination. Inside your first 12 months abroad without a filed exit, you remain a full Brazilian tax resident on worldwide income. If the destination also claims you as its own tax resident, there is no tie breaker clause and no guaranteed relief mechanism, only whatever unilateral foreign tax credit each side chooses to offer on its own terms.
- Significant issueCrypto tax and legal status
Crypto held on a foreign exchange loses the R$35,000 exemption entirely
Lei 14.754/2023 Art. 3 Section 1 I names ativos virtuais, carteiras digitais, virtual assets and digital wallets, explicitly as foreign financial investments, and Art. 2 Section 1 taxes them at a flat 15 percent annually with no deductions, no progressive scale and no exemption of any kind. Art. 3 Section 1 II puts the coin's price movement against the Real inside that same taxable income. The charge is realization based, triggered on redemption, disposal, maturity or liquidation, so moving the same portfolio from a Brazilian exchange to a foreign one converts what would have been an exempt small monthly disposal into a flat 15 percent charge with no R$35,000 buffer at all. Crypto held inside an offshore company or trust instead falls to the separate controlled-entity charge, 15 percent every 31 December whether distributed or not.
- Significant issueEmployer compliance
A late 2025 labour court ruling puts full CLT protection behind foreign remote contracts
The CLT attaches to work habitually performed in Brazil regardless of the employer's location or the contract's governing law, this territoriality principle is long-standing. What changed is a late 2025 Tribunal Superior do Trabalho ruling that a Brazilian resident working remotely from Sao Paulo for a US company was entitled to full CLT protections, with the court treating the habitual place of work in Brazil as decisive over the foreign contract. In practice this means a foreign employer and a foreign-law contract can be re-characterised as a Brazilian employment relationship, retroactively triggering CLT rights including 13th salary, FGTS, notice and vacation, plus INSS and eSocial duties for the employer. The risk scales with how long and how habitual the Brazil-based arrangement becomes, the source material does not give a bright-line day count, only that the risk grows the more settled the arrangement looks.
- Significant issueMoving your company
Law 14.754 taxes your offshore company's profits at 15 percent every year, distributed or not
Since Lei 14.754/2023 Art. 5, profits of a controlled entity abroad held by a Brazilian resident individual are taxed on 31 December each year at a flat 15 percent, whether or not any of it is actually distributed. Control means rights assuring preponderance in corporate decisions, or more than 50 percent of capital, profit or liquidation rights, directly or indirectly, alone or together with related parties, which reaches your spouse, companion and relatives to the third degree, plus entities where you hold over 10 percent of voting capital. The charge only applies if the entity fails one of two gateway tests, being in a favoured-tax jurisdiction, or having its own active income below 60 percent of total income, where active income excludes royalties, dividends, rents, interest and most capital gains. A personal holding company, a crypto-holding vehicle or a passive IP box fails the 60 percent test and gets taxed annually regardless of jurisdiction. A trust gives no shelter either, a controlled entity held through a trust is deemed held directly by the trust's beneficial owner.
- Significant issueSocial security
No agreement with your destination means you likely pay social contributions twice
Brazil has no social security agreement with your destination. There is no CDT and no exemption route available. Under Lei 7.064/1982 your Brazilian employer can and generally should keep paying your INSS contributions on your Brazilian salary, but the destination country will typically also levy its own social contributions on work performed on its soil, with nothing coordinating the two. This applies even to some EU countries, the Netherlands, Austria, Ireland and Poland among them, none of which has a Brazilian social security agreement despite being inside the EU.
- Significant issueImmigration and visa
Overstaying in Brazil costs R$100 a day, capped at R$10,000
Once every visit-based route is exhausted, typically 180 days total under the general extension, or less if you are an EU national under the new rolling window or did not extend, staying longer without a residence authorization like VITEM XIV is an overstay. The fine is R$100 per day statutory base (monetarily corrected to around R$204.77 per day in 2026), capped at R$10,000 total, under Article 109 of Lei 13.445/2017 of Lei 13.445/2017, collected by the Federal Police at departure before you are allowed to leave. Overstaying is treated as an administrative infraction rather than a criminal one, but it is reported to carry a one year re-entry restriction in practice, and tourist extension refusals are reportedly rising in 2026, pushing long stayers toward VITEM XIV instead of serial extensions.
