What the rules say about Portugal
The rules below are the ones most likely to shape a stay in Portugal, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueImmigration and visa
Past 90 days on a short-stay status, you are overstaying
Schengen short stays, visa-free or on a C-visa, max out at 90 days in any 180. Past that without a national visa or permit like the D8, administrative fines in the 400 to 1,500 euro band are commonly cited, rising with duration, and a Schengen-wide entry ban of 1 to 5 years is possible. The EU's Entry/Exit System, rolling out progressively from October 2025 and fully live by April 2026, auto-detects overstays by replacing manual passport stamping, so this is increasingly hard to slip past unnoticed.
- Significant issueTax residency
Past 183 days in any rolling 12 months, you become a Portuguese tax resident
This is a rolling 12-month test, not a calendar year, so it can straddle two tax years. Any day with an overnight stay counts, complete or partial. Once you cross it, you become resident from the first day of presence that met the test, Portugal recognises split-year residency, and worldwide income comes into scope for Portuguese tax, on top of whatever your home country still charges unless a treaty and its tie-breaker sort it out.
- Significant issuePermanent establishment risk
Signing contracts or managing from Portugal creates real permanent establishment risk
Habitually concluding or negotiating contracts that bind the employer, or exercising effective management from Portugal, are the two classic triggers for a dependent-agent or management permanent establishment under Article 5 of the CIRC. Risk also rises if the employer requires the Portugal location or pays for the workspace, effectively putting it at the company's disposal. A deemed PE brings Portuguese corporate tax on attributable profits and can trigger host payroll withholding too.
- Significant issuePersonal income tax
No treaty means no shield, and the 25 percent non-resident rate applies from day one
Without an in-force double taxation agreement between Portugal and your tax-residence country, there is no treaty relief to fall back on. The domestic 25 percent flat non-resident rate on Portuguese-source employment income applies without the protection a treaty would normally give a short stay, and if you cross into residency, worldwide taxation follows with no treaty tie-breaker if your home country also claims you. Two things soften this at the margin. Below EUR 920 a month in 2026, the minimum wage floor, no Portuguese withholding actually applies on single-employer income. And if you are resident in another EU or EEA state, you can claim a refund of any excess withholding above what the ordinary progressive rate table would give on your worldwide income, so the 25 percent acts as a ceiling rather than a fixed cost if you file for it.
- Significant issueRight to work
Working for Portuguese clients without the right visa is what's actually prohibited
What Portuguese immigration law clearly bans is entering the local labour market, meaning providing services to or being employed by Portugal-domiciled clients or employers, without the appropriate visa or permit. This is the one bright line in an otherwise grey area, and it applies regardless of how short the stay is.
- Significant issueLeaving home: exit tax and ties
Losing Portuguese tax residency is treated as selling all your crypto at market value
Portugal does not impose a general exit tax or mark-to-market charge on individuals changing tax residency, there is no deemed disposal of securities or real estate. Crypto is the sharp exception: under CIRS Article 10(1)(k) and the equiparacao (equivalence) paragraph, loss of Portuguese tax residency is expressly treated as a disposal of crypto-assets, holdings are deemed sold at market value on the date of departure, and unrealised gains on positions held under 365 days become taxable at 28 percent even though nothing was actually sold and no fiat was received. Whether crypto held 365 days or more before departure is exempt on this notional exit disposal is contested among practitioners and should not be relied on for planning, and any exclusion in any case only applies where the new residence is an EU or EEA state, or a jurisdiction Portugal has a tax treaty or information-exchange arrangement with. This is one of only four exit-style charges in the Portuguese individual tax code, and the only one that hits an ordinary investor with no corporate history.
