What the rules say about Austria

The rules below are the ones most likely to shape a stay in Austria, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueTax residency

A stay over six months makes you resident from day one, backdated

Section 26(2) BAO triggers unlimited tax liability once a stay in Austria exceeds six months, and liability is then extended back to the first day of the stay, not just the days after the threshold. This is not a calendar-year 183-day count, it is a straight six-month test on the actual stay, and many secondary sources wrongly simplify it as one.

  2. Significant issuePermanent establishment risk

Running your company from an Austrian home office can make the whole company Austrian tax resident

Section 27(2) BAO fixes corporate residence wherever day-to-day management actually happens, not where the company is registered. A founder or sole director who relocates to Austria and keeps running a foreign company from an Austrian home office risks making the entire company Austrian resident on its worldwide profits at 23 percent, not merely PE-taxable on a slice, and this is not covered by the below-50-percent home-office relief above. Austria fully reserved MLI Article 4 (BGBl III 145/2023), so this corporate dual-residence question is resolved automatically by place of effective management under each treaty tie-breaker, with no mutual agreement procedure available as an escape route, and the VwGH treats day-to-day management as decisive, holding that board meetings held abroad are not decisive (VwGH 2008/15/0211). The trap is sharper still for a solo operator: BMF-Information of 4 January 2026, GZ 2025-1.050.421, Tz 44.20, holds that where a solo founder or consultant is the only or main person carrying on the enterprise, the home IS a place of business regardless of the 50 percent working-time indicator, so the below-50-percent home-office relief above never applies to them at all.

  3. Significant issueLeaving home: exit tax and ties

Becoming Austrian tax resident starts a 27.5 percent exit tax clock that expressly names crypto

Section 27 Abs 6 EStG taxes a deemed disposal at fair market value, at 27.5 percent, the moment circumstances restrict Austria's taxing right, and it applies to shares, funds, derivatives and cryptocurrencies with no minimum shareholding threshold. EU and EEA residents can defer via a Nichtfestsetzungsantrag until actual disposal, but a 2026 tightening now requires an annual confirmation that no triggering event occurred, with a one-off 31 December 2026 catch-up filing deadline for any deferral going back to 2006. The AT-DE treaty shield that used to soften this was repealed from 1 January 2024.

  4. Significant issueImmigration and visa

Overstaying triggers fines and a Schengen-wide entry ban, not just an Austrian one

Unlawful stay carries fines from EUR 500 to EUR 15,000 depending on severity and repetition, backed by a return decision and an entry ban that under EU law covers the whole Schengen and EU area, not just Austria. Section 53 FPG sets a ban of up to three years where the person did not comply with an obligation to depart, and up to five years, ten years, or an unlimited term where the aggravating grounds in section 53(2) or 53(3) apply.

  5. Significant issuePermanent residency and citizenship

Naturalising in Austria costs you your existing passport, with only narrow exceptions

Section 10(3) StbG bars naturalisation unless you renounce your existing nationality, and section 27(1) automatically strips Austrian citizenship the moment you later acquire a foreign one, no decision or notice involved. Narrow exceptions exist: a Beibehaltungsbewilligung retention permit applied for and granted before acquiring the other nationality, cases where renunciation is genuinely impossible, and a fee-free route for descendants of people who fled Nazi persecution before 15 May 1955. The 2025-2029 government programme contains zero dual-citizenship reform and explicitly tightens other naturalisation criteria.

  6. Significant issueSocial security

No agreement at all means full double-coverage exposure

Singapore, the UAE and Indonesia have no social security agreement with Austria of any kind, so there is no certificate-of-coverage mechanism and no pension credit either. Even where a bilateral pension agreement does exist elsewhere on the roster, such as the US, Canadian, Australian or Brazilian agreements, it typically covers pensions only and gives nothing on health, accident or unemployment insurance.
