What the rules say about Belgium

The rules below are the ones most likely to shape a stay in Belgium, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueImmigration and visa

Past 90 days without a permit route, you're in overstay territory

Schengen visitor status, visa-free or via a C visa, caps out at 90 days in any 180. Beyond that a third-country national needs a single permit, professional card, or other residence document already in hand. Overstay triggers an order to leave the territory (Annex 13), a possible entry ban, and Schengen-wide SIS alerting.

  2. Significant issuePersonal income tax

Past 183 days, Belgium taxes your Belgian workdays from day one

Failing the treaty 183-day test does not mean only the excess days become taxable, it means Belgium can tax the Belgian workdays from day one of the whole period. Federal rates run 25 to 50 percent, plus a flat 7 percent non-resident surcharge, for an effective top marginal rate around 53.5 percent before social security.

  3. Significant issueMoving your company

Keeping a foreign holding company while managing it from Belgium risks dragging it into Belgian tax

A foreign company managed from Belgium risks becoming Belgian tax resident through place of effective management, and separately can create a permanent establishment through a fixed place of business or dependent agent. The BE-NL home-office guideline that protects an employee's telework only covers employer PE exposure, it does not protect a director or founder, where effective management is the real and unprotected exposure.

  4. Significant issueSocial security

No coordination exists for SG, AE and Indonesian corridors, double contributions loom

Belgium has 25 bilateral social security agreements plus EU Regulation 883/2004 coverage, but Singapore, the UAE and Indonesia are on neither list. Without a totalization mechanism, both your home system and Belgium can potentially claim contributions on the same work, with employee social security in Belgium running 13.07 percent of total gross with no cap at all.

  5. Needs checkingTax residency

Belgium has no day-count test for tax residency at all

Unlike most countries, Belgium does not use a 183-day rule to decide tax residency. Article 2 WIB 92 instead looks at domicile, the place of effective, continuous and habitual residence where your personal and family life is centred, or failing that the seat of wealth, the place from which your assets are managed.

  6. Needs checkingCrypto tax and legal status

Crypto gains now pay 10 percent by default, but the old speculation test survives underneath

The Law of 6 April 2026 brings crypto gains into a general capital gains tax for the first time, at 10 percent for normal management of private wealth with a EUR 10,000 annual exemption, but the new tax is conditional, only available where you can show your behaviour does not amount to speculation. Speculative activity outside normal wealth management still pays 33 percent with no exemption, and organised professional trading still pays progressive rates from 25 to 50 percent plus self-employed social security, judged by the DVB ruling commission's questionnaire weighing transaction frequency, leverage, automation, borrowed funds and share of financial wealth invested.
