What the rules say about Curaçao
The rules below are the ones most likely to shape a stay in Curaçao, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueLeaving home: exit tax and ties
The exit tax that actually bites is charged by the country you are leaving, not by Curacao
Curacao charges nothing on the way out, but several origin countries charge plenty on the way out of them. The Netherlands imposes a deemed disposal, the conserverende aanslag, on a substantial shareholding of 5 percent or more when you emigrate, Germany applies the same idea from a 1 percent shareholding, and the United States taxes covered expatriates under IRC 877A. If you hold shares in your own company above these thresholds, this origin-side charge is very likely the single largest tax event in your entire move, and it is set entirely on your home country's terms. Curacao itself is not an EU or EEA country, so deferring the Dutch assessment requires posting zekerheid, a bank guarantee or mortgage, rather than getting it automatically the way an EU-bound emigrant would. And since the Belastingplan 2016, the conserverende aanslag on a substantial Dutch shareholding no longer expires after ten years at all, it is onbeperkt geldig, unlimited in time. See the dedicated Curacao exit-tax findings for both points in full.
- Significant issueCrypto tax and legal status
Active crypto trading can disqualify you from the one regime that might tax your gains at 10 percent
The penshonado regime is the one workable route toward a lower crypto tax rate, foreign-source crypto gains held offshore can fall within its 10 percent rate on foreign income, or be absorbed entirely inside the XCG 500,000 deemed-income cap, one guide even frames it plainly as 0 percent on foreign-source gains specifically. But that same guide warns that active crypto trading may be reclassified as a business activity, which disqualifies penshonado status outright, and the regime already bars the taxpayer and spouse from business activity or employment as a baseline condition. Receiving local income in any year suspends the regime for that year only. Total, permanent loss of the regime requires two consecutive years of disqualifying local income, per the Belastingdienst's explicit rule. The statutory basis is precise, article 23D lid 3 of the Landsverordening op de inkomstenbelasting 1943 bars the regime where the taxpayer or spouse derives income from "het verrichten van handelingen, werkzaamheden of diensten van elke aard" in Curacao, activities, work or services of any kind. Active trading conducted from Curacao plausibly falls within that broad wording.
- Significant issuePermanent establishment risk
Signing contracts or managing the company from Curacao creates real PE risk
Habitually concluding or negotiating contracts that bind your employer, working from Curacao as a dependent agent, is the classic trigger for a dependent-agent permanent establishment. If a director or senior manager runs the company from here, that's a place-of-effective-management risk on top. Either one can pull the employer into Curacao corporate tax on the profit attributable to that activity.
- Significant issuePersonal income tax
Moving your Dutch BV to Curacao with you converts its dividends from foreign to domestic and ends the 10 percent
Article 23E(1)(f) and (g) of the Landsverordening op de inkomstenbelasting 1943 only classify dividends and aanmerkelijk belang gains as foreign-source when the paying company is not effectively or statutorily established in Curacao. Relocate the BV's seat or effective management to Curacao alongside you, and those same dividends become domestic income taxed at the ordinary progressive rates up to 46.5 percent instead of the flat 10 under penshonado. Moving the company itself can separately trigger a Dutch corporate exit charge and, if the two tax authorities cannot agree on residence, leave you with a dual-resident company that loses almost every BRNC treaty benefit, see the territorial profit tax and substance findings for the company-level consequences.
- Significant issueImmigration and visa
Past a year, there's no visa or permit route left to extend on, unless you are Dutch
The @HOME remote-worker permit runs 6 months, extendable once by another 6, for a maximum of 1 year, and the programme is explicit that after that you will not become a resident of Curacao through this route. There's no further extension available. Staying beyond a permit's expiry is an overstay under LTU Article 23 lid 2, punishable by detention up to 1 month or a fine of up to ANG 500, on top of expulsion proceedings. This finding is scoped to nationalities other than Dutch. A Dutch national is not on a permit clock at all past a year, LTU Article 3(1)(f) admits an adult Dutch national van rechtswege, open-ended, with no absence rule attached to that admission route, see the separate Dutch van rechtswege finding.
- Significant issueMoving your company
Genuinely running your company from Curacao creates the exposure you moved to avoid
Excluding foreign profit from the territorial tax base is not automatic. Profit Tax Ordinance Article 1C requires real substance, sufficiently qualified employees and recurring operational costs appropriate to the company's actual activities. A foreign company with a fixed place of business in Curacao is itself subject to Curacao profit tax, as is a foreign entity holding Curacao real estate or claims secured by a mortgage on it. This is the harder case than an employee working remotely for a foreign employer, if you are the founder or director and you genuinely run the company from here, you create a Curacao permanent establishment, or shift effective management here, by design rather than by accident.
What tends to surprise people here
- Even Dutch nationals need formal admission (toelating), it is not automatic
- The @HOME permit caps at one year and grants no residency
- Serving the local market needs a separate work permit
