The POEM trap, incorporate a Kft and keep running it from the Netherlands, and the 9 percent evaporates
A Hungarian Kft is Hungarian tax resident by incorporation under Tao tv. 2 paragraph (2), but Tao tv. 2 paragraph (3) also makes any non-resident entity Hungarian-resident if its principal place of business management is in Hungary, and the reverse trap is the real danger, if the Kft is actually directed from the Netherlands, the Netherlands treats it as Dutch-resident on feitelijke leiding, and NL-HU treaty Article 4 lid 3 breaks the residence tie on place of effective management, which lands on the Netherlands. The result is Dutch vennootschapsbelasting at 19 percent up to EUR 200,000 and 25.8 percent above, on worldwide profit, while Hungary is reduced to taxing a permanent establishment if one even exists. The founder has then paid HUF 3,000,000 of share capital, Hungarian accounting fees, HIPA and the director-member contribution floor, for a Dutch tax bill. What actually protects the structure is genuine Hungarian management, board meetings held and minuted in Hungary, the director resident there, bank mandates exercised there, a real office, not a registered-seat service address with a Dutch founder still working from Amsterdam. If director fees are paid to a Dutch-resident director, NL-HU treaty Article 16 taxes them in Hungary with no day-count relief, and the Netherlands relieves that charge by exemption with progression under Article 24, so the exposure is the Hungarian charge itself, not a compounding double hit.
- Significant issueTax residency
At 183 days in the calendar year, you become Hungarian tax resident automatically
Szja tv. 3. paragraph (2) limb (b) is automatic for an EU national exercising free movement, once you reach 183 days of presence in Hungary within the calendar year, counting both the day of entry and the day of exit, you are Hungarian tax resident from that day, full stop, no separate intent test. Note this is a calendar-year count that resets every 1 January, not a rolling 12-month window like most modern treaties use, so the practical totalDays12m figure this engine tracks is an approximation of a genuinely different statutory mechanic. If your days split across a calendar-year boundary, for example a stretch before and after 1 January, recount each portion against its own calendar year before treating this RED as live, a rolling totalDays12m of 183 or more does not automatically mean either calendar year itself reached 183. A Hungarian resident is taxed on worldwide income at the flat 15 percent rate. Only the NL-HU treaty tie-breaker in Article 4 can then pull dual residence back toward the Netherlands.

KATA looks like the cheapest Hungarian regime and is a trap for almost every NaVi persona
KATA (kisado zo vallalkozok tetetles adoja, Act XIII of 2022) charges just HUF 50,000 a month with an HUF 18,000,000 annual ceiling, but its scope after the 2022 rewrite is business-to-consumer sole traders only. Receiving revenue from any kifizeto, a term that expressly includes a foreign kifizeto, terminates KATA status with effect from the day before the payment arrives, it is not a penalty, it is deletion of the status. A Hungarian freelancer who invoices a Dutch BV loses KATA the day before the first payment lands, and there is no cross-border workaround because the definition reaches foreign payers by design. KATA is realistically usable only by a genuinely consumer-facing sole trader, a hairdresser, a driving instructor, a market trader, not by anyone billing a company, foreign or Hungarian.

Hungary has not signed the cross-border Telework Framework Agreement, the corridor's single biggest fact
The multilateral Framework Agreement under Article 16(1) of Regulation 883/2004 lets a cross-border teleworker stay insured in the employer's state while working up to 50 percent of the time from home. Belgium, the depositary state, publishes the authoritative signatory list, 23 states as of this research including the Netherlands, Germany, Spain, Poland and Slovakia. Hungary is not on that list. The safe harbour that makes remote work from those other countries straightforward for a Dutch, German or Spanish employer simply does not exist for an employee based in Hungary. Ordinary Article 13(1) rules apply instead, without any derogation option beyond a discretionary, slow, case-by-case bespoke agreement between the two national authorities.
- Needs checkingPermanent establishment risk
Hungarian labour law forces an employer to audit and approve a home office, which is exactly the evidence a permanent establishment claim needs
Under the NL-HU treaty, Article 15 lid 2's residence-state exemption for a short-term employee fails if any one of three conditions is not met, and one of them is that the remuneration must not be borne by a Hungarian permanent establishment of the employer. Separately, Hungarian labour law (Mt. 196-197 on tavmunkavegzes, telework) requires the employer to agree telework in writing, reimburse costs, and critically to audit and approve the telework location, with the employee needing the employer's approval to change it afterward. A location the employer has inspected, approved and controls sits materially closer to being at the disposal of the enterprise than an unregulated home office in a country without that legal duty. If a Hungarian permanent establishment is found, Article 15's day-count relief fails regardless of how few days were spent in Hungary, and the employer faces a Hungarian corporate filing at 9 percent plus HIPA on the PE's profit.

What genuine relocation needs to look like, to protect every structure built on top of it
The single most valuable thing a relocating founder can build is a paper trail that a genuine move happened, since it is what protects a Kft from the POEM trap, supports a Hungarian tax residence claim against a Dutch challenge, and underpins every planning route in this corridor. In practice that means, together, a registration certificate and address card, a TAJ healthcare number, a real lease or property purchase rather than a nominal address, family present if applicable, board meetings actually held and minuted in Hungary, bank mandates exercised from Hungary, a NAV illetosegigazolas on file, and formal Dutch BRP deregistration. Missing several of these at once is what turns a 9 percent corporate tax story into a Dutch tax bill instead.
What tends to surprise people here
- KATA is effectively dead for anyone with business clients, one foreign payment ends the status
- Local business tax up to 2 percent of revenue comes on top of the 9 percent headline
- No telework framework agreement, social security flips at 25 percent of working time
