What the rules say about Mexico
The rules below are the ones most likely to shape a stay in Mexico, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueTax residency
Setting up a home in Mexico can make you a tax resident regardless of how many days you spend there
Mexico does not use a simple day count as its primary residency test. Under Article 9 of the Codigo Fiscal de la Federacion, establishing a casa habitacion, a home, in Mexico makes you a Mexican tax resident in principle, independent of days present. Combined with other local ties, family, property or business connections, this abode limb can catch a remote worker who never planned to become a tax resident, well before any 183-day mark most people assume matters. This is more aggressive than the plain day-count rules used elsewhere, treat renting or settling into a home here as a tax decision, not just a lifestyle one.
- Significant issuePermanent establishment risk
Signing contracts or making management calls from Mexico creates real permanent establishment risk
Where the Mexico-based worker regularly negotiates or concludes contracts on behalf of the foreign company, acts as its representative before Mexican clients, or performs key revenue-generating or decision-making functions from Mexico, the company can be treated as operating through a dependent-agent permanent establishment there, and becomes subject to Mexican corporate income tax obligations on top of whatever payroll exposure follows.
- Significant issueImmigration and visa
Past 180 days the visitor route is closed, and it cannot be extended from inside Mexico
The tourist or visitor permit cannot be renewed or extended in country. Once you need more time than you were granted, or more than 180 days outright, your only lawful moves are to leave and re-enter, itself increasingly scrutinized as a visa run, or to have already switched to a residency track before you needed to. Overstaying instead triggers a fine paid to INM at the port of exit under Article 73 of the Ley Federal de Procedimiento Administrativo, scaled to days overstayed and denominated in UMA (MXN 117.31 per day in 2026). A short overstay does not trigger an automatic ban, but longer or repeat overstays raise real re-entry risk.
- Significant issuePersonal income tax
There is no new-resident tax break, worldwide income is taxed at up to 35 percent from day one
Mexico has no impatriate regime, no non-dom regime, no remittance basis and no lump-sum regime. A new arrival is taxed identically to a lifelong resident from day one, once resident under the casa habitacion or centre-of-vital-interests tests covered elsewhere in this corridor, worldwide income is taxed on the 2026 progressive scale running 1.92 to 35 percent, the top rate biting above MXN 5,107,703.93. The only named shelter, RESICO, is a general small-taxpayer regime open to anyone, not an inbound incentive. A foreign tax credit is available but limited to the lesser of the foreign tax actually paid on foreign-source income taxable in Mexico and the Mexican tax attributable to that income, with no credit on Mexican-exempt income. The 2026 Paquete Economico reform package, presented 8 September 2025 with the Resolucion Miscelanea Fiscal 2026 published in the DOF on 28 December 2025, restructured anti-fraud invoicing rules and RESICO payment timing but did not touch individual rates and did not create any new-resident regime.
- Significant issueMoving your company
REFIPRE, the CFC regime, catches individuals too, not just companies, and this is the rule most movers miss
Where a Mexican resident holds an interest in a foreign entity whose income is untaxed abroad or bears foreign tax below 75 percent of what Mexico would have charged, LISR Title VI Chapter I includes that income in the resident's own return on accrual, even if nothing is ever distributed. The active-business exception fails once passive income from indirect investments exceeds 20 percent of total income. Compliance runs through the annual tax-haven informative return due 28 February. A founder who moves to Mexico and keeps an offshore holding company running is squarely inside this, it is not a company-level rule they can leave to their accountant back home, it attaches to them personally as a Mexican tax resident.
- Significant issueCrypto tax and legal status
Trading actively risks a business classification with no binding line drawn yet
Habitual crypto trading operation requires SAT registration under a business activity classification. RESICO is arithmetically available below the MXN 3,500,000 ceiling, but SAT has indicated that disposal gains belong in their own LISR chapter and are not always compatible with RESICO where trading is the principal or recurring activity. No binding published SAT criterion draws the line between an active investor and a commercial trader, this is the largest unresolved question for a high-volume holder.
What tends to surprise people here
- 180-day entries are discretionary now, officers often grant less
- A local home can make you tax resident regardless of days
- US nationals get no totalization relief, that agreement was never ratified
