What the rules say about Australia

The rules below are the ones most likely to shape a stay in Australia, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueRight to work

Doing your normal remote job on a visitor visa is a technical breach, and the downside is severe

eVisitor and ETA both carry condition 8115, which only permits defined business visitor activity, things like negotiating a contract or attending a conference. Regular remote work for a foreign employer sits outside that exhaustive list, so it is a technical breach on the face of the instrument, and an outright breach of condition 8101 if you hold a Tourist-stream 600 visa instead.

  2. Significant issueMoving your company

Moving yourself to Australia can drag your foreign company into Australian tax residency with it

A company is an Australian tax resident if incorporated in Australia, or if it carries on business in Australia with either central management and control here or Australian-resident shareholder control. The ATO's position is that a foreign company carrying on business with its central management and control in Australia carries on business here, even where all trading happens elsewhere. There is no general inbound redomiciliation mechanism, restructuring means incorporating a new Australian company and transferring assets or interposing a holding structure.

  3. Significant issuePermanent establishment risk

Signing contracts or making management decisions abroad creates real tax exposure for your Australian employer

An employee who habitually concludes contracts or exercises real management authority while working from another country is exactly what dependent-agent and management permanent establishment tests are designed to catch, under that country's own domestic law and the relevant DTA's permanent establishment article. This is a per-destination determination, but the shape of the risk is a standard consequence of the permanent establishment concept Australia's own corporate tax rules confirm: it exposes your employer to host-country corporate tax, registration and payroll obligations they never planned for.

  4. Significant issueHealthcare coverage

No Reciprocal Health Care Agreement covers this destination, so Medicare gives you nothing here

Your destination is not one of the 11 countries with a Reciprocal Health Care Agreement with Australia, which covers the United Kingdom, Ireland, New Zealand, Sweden, the Netherlands, Finland, Italy, Belgium, Norway, Slovenia and Malta. Outside that list, including most of Europe, the United States and most of Asia, Medicare gives you zero access to care abroad. Private international health insurance is effectively mandatory in practice for a trip like this.

  5. Needs checkingImmigration and visa

Working Holiday or Work and Holiday gives you a real right to work, with real limits

Your nationality is eligible for the 417 Working Holiday or 462 Work and Holiday visa, the only route that gives an ordinary young traveller genuine work rights without needing an employer sponsor. Age caps run 18 to 30, extended to 18 to 35 on the 417 for a handful of countries, and you cannot work more than 6 months for the same employer.

  6. Needs checkingResidency routes

There is no investor visa, no golden visa and no digital nomad visa in Australia

The Business Innovation and Investment Program, Australia's investor and golden-visa route, closed to new applicants before 31 July 2024 with no replacement, only existing holders can progress through it. Separately, Australia has no digital nomad, remote worker or location-independent visa of any kind, confirmed by its absence from the current Migration Regulations Schedules.

What tends to surprise people here

  • No investor visa, no golden visa and no digital nomad visa in Australia
  • Points-tested skilled migration rarely succeeds on points alone, most need employer sponsorship
  • From 1 July 2027 the 50 percent crypto CGT discount is replaced by a 30 percent floor
