What the rules say about Canada
The rules below are the ones most likely to shape a stay in Canada, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueTax residency
183 days of presence makes you a deemed resident for the whole year
ITA 250(1)(a) deems anyone who sojourns in Canada 183 days or more in a calendar year a resident for the entire year, retroactive to 1 January, on worldwide income. Days are not required to be consecutive, and CRA treats any part of a day present, including arrival and departure days, as a full day.
- Significant issueMoving your company
Running your foreign company from Canada can make the whole company Canadian
A non-resident company creates a Canadian permanent establishment through a dependent agent who habitually concludes contracts on its behalf, and a relocating founder signing contracts for their foreign company is the textbook case. Worse, Canadian common law treats a corporation as resident where central management and control is actually exercised, so relocating the sole director risks making the entire foreign company Canadian tax resident, not just giving it a PE.
- Significant issueRight to work
Serving Canadian clients or a Canadian branch breaks the visitor exemption
The remote-work carve-out depends entirely on the employer having no Canadian presence and the worker not entering the Canadian labour market. Taking on a Canadian client, signing contracts locally, or working for a Canadian branch or subsidiary of your employer requires a work permit, even if a foreign company pays you.
- Significant issueHealthcare coverage
Visitors get no provincial healthcare coverage
Provincial health plans are residence-based and every province excludes visitors. Ontario states it flatly for OHIP, and an uninsured hospital admission is billed at full non-resident rates. No statutory insurance requirement exists because there is no nomad visa to attach one to, but the practical need is real.
- Significant issueCrypto tax and legal status
Active trading risks a business-income assessment that doubles the tax bill
If CRA views your crypto activity as a business, 100 percent of the profit is taxable with no 50 percent shelter, versus the capital gains rate otherwise. CRA weighs businesslike operation, intention to profit, frequency and volume, short holding periods, specialised knowledge, leverage and promotion. There is no safe harbour and no bright-line day-count test, only facts.
- Needs checkingEmployer payroll obligations
Regulation 102 obliges your employer to withhold Canadian payroll tax, even if you owe nothing
ITR 102 applies to any person, explicitly including a non-resident employer, who pays wages for services performed in Canada. CRA is explicit that withholding is mandatory even where the employee is certain to be treaty-exempt. A foreign employer with zero Canadian footprint acquires a Canadian withholding, remitting and T4 obligation the moment you open your laptop on Canadian soil.
What tends to surprise people here
- Visitors get no provincial healthcare coverage
- The 183-day sojourner rule triggers deemed residency for the whole year
- Regulation 102 obliges employer withholding even when no tax ends up owed
