What the rules say about Guyana

The rules below are the ones most likely to shape a stay in Guyana, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueMoving your company

Running your foreign company from Georgetown can make it Guyanese, with no treaty tie-breaker

Guyana defines corporate residence by central management and control, any body of persons whose business is controlled and managed in Guyana, with place of incorporation alone not sufficient. A founder who relocates to Georgetown and keeps directing their foreign company from there risks making that company Guyanese tax resident on its worldwide profits. In a treaty country a tie-breaker clause would resolve the resulting dual residence. With thirteen of sixteen roster nationalities having no treaty with Guyana at all, there is no tie-breaker, so both countries can simply tax the company. Guyana also has no statutory permanent establishment definition, so the authorities apply general common law principles with no bright-line threshold to plan against.

  2. Significant issueImmigration and visa

There is no digital nomad visa, and a viral claim of one is false

The official Immigration Support Services eServices platform, relaunched in October 2025, lists exactly five categories: Visitor, Business, Employment and Student visas, plus Landing Permits. There is no remote-work, nomad or freelancer category. A 2026 content-farm article claiming Guyana launched a digital nomad visa in 2025 with a roughly USD 2,000 a month income floor is unsupported by any Guyanese government source and contradicted by the official platform. Treat that claim as fabricated.

  3. Significant issuePersonal income tax

Guyana has three tax treaties in force, and yours is probably not one of them

Guyana has three double taxation instruments in force, with Canada in 1987, the United Kingdom in 1992, and CARICOM in 1995. A fourth, with the United Arab Emirates, was signed on 24 March 2022 and approved by the UAE Cabinet on 10 December 2023, but no Guyanese Order or entry-into-force date has been published, so it gives no relief yet. Thirteen of the sixteen requested roster nationalities, including the United States, have no treaty in force at all, meaning no Article 15 relief on employment income, no reduced withholding, no permanent establishment threshold article, and no mutual agreement procedure to resolve a dispute. Relief for these nationalities depends entirely on the home country's own unilateral foreign tax credit rules.

  4. Significant issueTax residency

Six months or more within the single preceding year forfeits the section 47 shelter

Section 47 measures whether the person has resided in Guyana for periods totalling 6 months in aggregate within the single year immediately preceding the year of assessment, not cumulatively across multiple years. A visitor who spends 7 months in Guyana in year one has resided 6 months or more within that one preceding year, so the section 47 exemption is unavailable for year one's own assessment. A visitor who spends only 5 months in year one keeps the shelter, since 5 months is under the 6 month threshold within that single preceding year, and the count resets each year rather than compounding forward from a prior stay. This reading follows directly from the statute rather than from any confirmed GRA practice note.

  5. Significant issueResidency routes

No digital nomad visa, no golden visa, no investor route, no retiree route

Guyana has built none of the relocation instruments the rest of the Caribbean has built. There is no digital nomad visa, no investor or golden visa, no citizenship by investment and no passive-income or retiree route. The only doors are employment through a sponsored work permit, business presence, family through marriage to a Guyanese citizen, or CARICOM nationality, and none of the 16 roster nationalities is CARICOM. CARICOM's 6 month visa-free stay and its Skilled National Certificate route are both real but deliver zero benefit to this roster.

  6. Needs checkingRight to work

Section 6 turns days physically worked in Guyana into Guyana-source income

Income Tax Act section 6 deems the gains from any employment exercised in Guyana to be Guyana-source, whether received in Guyana or not. A genuine short-stay visitor working remotely can shelter that income under section 47, see the tax residency rules, but once that shelter is lost, by staying long enough, forming an intent to reside, or having resided 6 months in the prior year, the salary for days physically worked in Guyana becomes Guyana-source income regardless of the employer's location or the currency and account used to pay it.

What tends to surprise people here

  • No digital nomad visa exists, despite a viral claim that one launched in 2025
  • Only three tax treaties are in force, Canada, the UK and CARICOM
  • Running a foreign company from Georgetown can make the company itself Guyanese tax resident, with no treaty tie-breaker
