What the rules say about Montenegro
The rules below are the ones most likely to shape a stay in Montenegro, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueTax residency
Past 183 days in the tax year you become a Montenegrin tax resident
Montenegro's Personal Income Tax Law counts you as a tax resident once you spend at least 183 days in Montenegro in a tax year. Unlike some countries this is a calendar-year count, not a rolling 12-month window, so a stay that spans two calendar years can look different from a simple day count. Residency brings your worldwide income into the Montenegrin tax net.
- Significant issuePermanent residency and citizenship
Montenegro does not allow dual citizenship, a major decision point
Under the 2008 Citizenship Act, a Montenegrin who acquires another citizenship loses their Montenegrin citizenship, and foreigners naturalising are in principle required to renounce their prior citizenship first, unless a bilateral treaty says otherwise. There is no general dual-citizenship allowance.
- Significant issueImmigration and visa
Past 90 days you need the digital nomad permit or another residence route
The 90-day visa-free window is a hard ceiling for stays without a permit. Beyond it you need Montenegro's dedicated digital-nomad temporary residence permit or one of the other residence routes. Specific overstay penalty figures were not found in a primary source, but Montenegro enforces overstays through fines, removal and possible re-entry bans under the Law on Foreigners, so this is not a line worth testing.
- Needs checkingResidency routes
Real estate ownership is the most direct residency route, at a EUR 150,000 threshold
Montenegro has no golden visa for a simple fund subscription and no passive-income or pensioner-specific visa. The most direct route to residence is owning property with a minimum taxable value of EUR 150,000, a threshold that took effect in 2026, since before that any value qualified and pre-2026 buyers are grandfathered in. The permit runs 1 year at a time, renewed annually. Retirees without another route in mind typically use this one.
- Needs checkingRight to work
The digital nomad permit is the compliant route for longer remote work stays
Montenegro runs a dedicated digital-nomad temporary residence permit for freelancers with foreign clients, entrepreneurs, and employees of a company registered outside Montenegro. It is issued for 2 years and renewable once for another 2, so 4 years total, but the programme itself is scheduled to stop accepting new applications on 31 Dec 2026 with no confirmed extension. Permits already issued keep running as normal. Apply well before the deadline if you want this route. The income bar is framed as 3x the Montenegrin minimum wage rather than a fixed figure, so it moves with the minimum wage each year. You also need a valid passport, proof of remote work, international health insurance, a clean criminal record and accommodation. The upside is real: foreign-source self-employment or independent income earned on this permit is tax-exempt in Montenegro.
- Needs checkingPersonal income tax
Long stays without a tax treaty risk unrelieved double taxation
Montenegro has no in-force double taxation agreement with the United States, Canada, Australia, Brazil, Singapore or Indonesia. Past 183 days Montenegro taxes your worldwide income under its domestic rules, and without a treaty there is no tie-breaker and no guaranteed relief mechanism, only whatever unilateral credit your home country happens to offer.
What tends to surprise people here
- Owning property or having your centre of interests here can trigger residency regardless of days
- No confirmed social security coordination with most tracked nationalities
- No tax treaty with the US, Canada, Australia, Brazil, Singapore or Indonesia
