What the rules say about Puerto Rico
The rules below are the ones most likely to shape a stay in Puerto Rico, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueImmigration and visa
Overstaying US immigration status triggers multi-year re-entry bars
Puerto Rico enforces US federal overstay rules. More than 180 days of unlawful presence followed by departure triggers a 3-year re-entry bar to the whole United States, and more than a year triggers a 10-year bar. An overstay also voids future ESTA/VWP eligibility, forcing a full visa application next time.
- Significant issueRight to work
Gainful local employment without US work authorization is not permitted
Being employed by or paid from a Puerto Rico-based source is gainful employment in the US labor market, which visitor status such as ESTA or B-1/B-2 never authorizes for a non-US national. 9 FAM 402.2-5(B) permits negotiating contracts and consulting business associates on a business visit, so that alone is not the violation. The real line is being on a local payroll or paid from a local source without work authorization.
- Needs checkingResidency routes
No Puerto Rico golden visa or nomad visa exists for foreign nationals
Foreign nationals get no Puerto Rico-specific residency route: no passive-income visa, no D7 equivalent, no retirement visa, no golden visa. The only paths in are standard US immigrant categories such as EB-5 investor (USD 800,000 in a Targeted Employment Area or USD 1,050,000 standard, creating 10 jobs), E-2 treaty investor, employment-based green cards, or family sponsorship.
- Needs checkingCrypto tax and legal status
Pre-move crypto gains stay US-taxable for 10 years, since moving does not wash them out
The IRC 937(b) 10-year lookback bifurcates gains on crypto you held before moving to Puerto Rico. Appreciation that accrued before your PR residency began stays US-source and fully federally taxable if sold within 10 years of establishing residency, and only the post-move slice gets the Act 60 0 percent rate. Puerto Rico separately applies its own reduced rate to the pre-move slice, roughly 10 percent within 10 years of residency and 5 percent after. There is no PR-level exit tax on ceasing residency later, since the 10-year federal lookback is the real constraint, not a deemed-disposal charge.
- Needs checkingPersonal income tax
Days physically working in Puerto Rico can generate taxable local income
Puerto Rico sources personal service income to where the work is physically performed, not where the employer sits. Even as a nonresident, days spent actually working in Puerto Rico, especially serving local customers or signing contracts there, can create PR-source income taxed on a prorated basis.
- Needs checkingTax residency
183 days in Puerto Rico opens the door to bona fide residency and local residency
183 days or more of presence in a calendar year satisfies both Puerto Rico's local tax-residency presumption and one of the five federal bona fide residence presence tests. Presence alone is not enough for the federal status though, since you also need the tax home test and the closer connection test to hold for the full year.
What tends to surprise people here
- No US tax treaty ever extends to Puerto Rico
- More than 180 days of unlawful presence triggers a 3-year US re-entry bar
- Days actually spent working locally can create taxable PR-source income
