What the rules say about Morocco

The rules below are the ones most likely to shape a stay in Morocco, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueTax residency

Meeting any one of the three Article 23 tests makes you a Moroccan tax resident on worldwide income

Because the three CGI Article 23 tests are independent, not cumulative, you do not need to pass 183 days to become resident: a permanent home in Morocco or your centre of economic interests being there is enough on its own. Once resident, Morocco taxes worldwide income at the progressive personal rates, foreign employment income, business income and (subject to the specific pension rules elsewhere in this file) pension income all come into scope.

  2. Significant issueRight to work

A Moroccan employer or local contract-signing crosses into work that needs an approved permit

The work permit and the residence card are described as an inseparable pair in Moroccan practice, one is not issued without progress on the other. Signing contracts locally, invoicing as a Moroccan-based supplier, or working for an entity established in Morocco all cross from foreign remote work into the Moroccan labour market, regardless of your entry status or nationality.

  3. Significant issueImmigration and visa

Past 90 days without a carte de sejour, you are staying illegally regardless of intent

Beyond 90 days on Moroccan soil, whatever your entry route, a carte de sejour issued by the local police (surete nationale) is the only lawful basis to remain. There is no automatic extension and no grace period built into the visa-free allowance itself. I could not source exact fine amounts or the current administrative practice on regularisation for this file, treat the RED status as the trigger to get local advice rather than as a quoted penalty.

  4. Significant issuePermanent establishment risk

A Moroccan company actually run from a Dutch kitchen table is very likely a Dutch taxpayer too

Under Article 4, a company's residence for treaty purposes follows the state where its actual management and control sit, and the treaty's tie-breaker for non-individuals looks at where the enterprise is genuinely managed, not just where it is incorporated. Incorporating a company in Morocco while the founder keeps making every real decision from the Netherlands, board meetings by video call from a Dutch address, contracts signed there, strategy set there, risks the company being treated as Dutch-managed for tax purposes regardless of its Moroccan registration. The treaty tie-breaker does not automatically rescue this, place-of-effective-management is a facts-and-circumstances test the Dutch tax authority applies aggressively.

  5. Significant issueSocial security

Ordinary child benefit export to a child living in Morocco stopped for new claims from 1 January 2021

Since the 2017 treaty amendment took effect, the published woonlandfactor table for Morocco explicitly states it applies only to people working in the public interest (werkzaam in het algemeen belang) who established kinderbijslag rights for a Morocco-resident child on or after 1 January 2021, per the official annex to the woonlandbeginsel regulation. For an ordinary claimant outside that narrow category, new export of kinderbijslag and the related kindgebonden budget to a child resident in Morocco does not apply. This is a materially different, stricter position than the general "Morocco is a treaty country so child benefit continues" framing still common online.

  6. Significant issueCrypto tax and legal status

Crypto transactions have been officially declared illegal in Morocco since 2017, and that position has not been repealed

A joint communique from the Ministry of Finance, Bank Al-Maghrib and what is now the AMMC, dated 21 November 2017, declared crypto-asset transactions a breach of Moroccan exchange control regulations, citing money-laundering, terrorist-financing and consumer-protection concerns. That communique has not been withdrawn, even as a new regulatory framework (see the separate 2026 rule in this file) moves through the legislative process.
