What the rules say about El Salvador

The rules below are the ones most likely to shape a stay in El Salvador, in plain words and with the source behind each one. Your own report tells you which of them apply to you.

  1. Significant issueImmigration and visa

Past 180 days you need a DGME extension or a residence permit

El Salvador's visa-free admission is 180 days, not 90 days plus a 90-day top-up. Past 180 days you are not automatically out of lawful options: you can apply in-country for a DGME extension, or move to a residence permit route (Digital Nomad Visa, Rentista, Pensionado or Investor, see Part B). A specific overstay fine could not be confirmed from a primary source, so treat that as a genuinely open question rather than a known-low penalty.

  2. Significant issueRight to work

Local employment or local clients is prohibited on visitor, Nomad or Rentista status

Working for a Salvadoran company or serving local clients is prohibited on the tourist, Digital Nomad and Rentista statuses, even if paid in cash. This is a hard line that the tax-exemption story does not soften.

  3. Significant issuePersonal income tax

Salvadoran-source income is taxed even though foreign income is not

The territorial exemption only covers foreign-source income. Salvadoran-source income earned by a non-domiciled person is taxed at a flat 30%, and specific service payments to non-domiciled persons carry a 20% final withholding under Codigo Tributario Art. 158.

  4. Needs checkingTax residency

A secondary test can trigger domicile regardless of day count

Codigo Tributario Art. 53 also grants domicile where a person keeps their 'main seat of business or economic activity' in El Salvador - for example local employment or a professional office here. Signing contracts or making management decisions locally can trip this test independent of how many days you have spent in-country.

  5. Needs checkingSocial security

No totalization agreement - your home country's rules decide everything

El Salvador's only social security coordination is the Ibero-American convention (Spain, Portugal, Brazil). Outside those three, there is no certificate-of-coverage mechanism and no coordination with El Salvador - EU Regulation 883/2004 does not apply here either, since El Salvador is outside the EU/EEA.

  6. Needs checkingResidency routes

Temporary residents must keep at least 90 days of presence per year

Decreto No. 531 (effective 31 March 2026) requires every temporary resident, including Nomad and Rentista holders, to remain in El Salvador at least 90 calendar days per year, consecutive or accumulated, with narrow force-majeure exceptions. Falling short risks residency cancellation under the amended Art. 49. It is unconfirmed whether this 90-day rule now also governs the separate 3-year path to permanent residency, which previously used a stricter 8-months/year presence test.

What tends to surprise people here

  • The 200-day domicile test must be consecutive, not just cumulative
  • Only one tax treaty and totalization pact in force, both with Spain
  • Confirmed overstay fines past 180 days could not be found
