What the rules say about Paraguay
The rules below are the ones most likely to shape a stay in Paraguay, in plain words and with the source behind each one. Your own report tells you which of them apply to you.
- Significant issueSocial security
No coordination with your destination means double social security contributions are a real risk
Paraguay is not part of EU Regulation 883/2004 and cannot issue an A1 certificate or anything equivalent for any destination, so an employee posted to an EU or EEA state gets zero recognition of continuing IPS coverage there. Outside a treaty country, ordinary lex loci laboris applies: if the destination compels local social security enrollment for work done on its soil, you can end up paying into both IPS in Paraguay and the local system at the same time, with no offset. IPS coverage itself keeps running as long as your Paraguay employment and contributions continue, it just is not exempted anywhere without a specific agreement. Separately, Paraguay has no contributory unemployment insurance program at all, IPS covers health, maternity, sickness, disability, old-age and survivors but not job loss, so there is no unemployment benefit to lose by working abroad either. Protection against dismissal comes through statutory severance instead. Where the destination itself is the Netherlands, note that Paraguay and the Netherlands do have a social security export and enforcement treaty in force since 1 March 2008, but it only lets benefits already in payment follow the person, it does not coordinate contributions or exempt a PY-posted worker from Dutch local social security, so the double-contribution risk described above still applies for a Netherlands posting.
- Significant issueImmigration and visa
Past 180 days you are outside every visitor route
180 days is the hard ceiling for Paraguay's tourist and visit routes, 90 days plus one 90-day extension. There is no third extension. Staying longer needs a temporary or permanent residency permit arranged through Migraciones. Missing your entry stamp is separately known to trigger a fine on exit, most often at land borders. The exact overstay fine amount for exceeding 180 days was not confirmed.
- Significant issuePersonal income tax
A Dutch BV's statutory director is taxed by the Netherlands wherever he sits, and Paraguay taxes the same work too
Wet IB 2001 art. 7.2(7) deems a statutory director or commissioner of a Netherlands-established body to have carried out that role in the Netherlands, for Dutch tax purposes, regardless of where he physically works. Wet LB 1964 art. 2(3) mirrors this on the withholding side, but only conditionally for a director or commissioner: the non-resident wage-tax exclusion applies to him only where the conditions in art. 2(4) are met, so withholding can stop on this corridor once Paraguay taxes the fee, even while Dutch income tax still reaches it under art. 7.2(7). Meanwhile Paraguay, on Ley 6380/2019 art. 48's general rule and DNIT's own reasoning on physical presence, treats the same director's fees as Paraguayan-source once the work is physically performed from Paraguay. There is no Netherlands-Paraguay tax treaty to allocate the income between the two states, and Paraguay's only foreign tax credit, art. 134, is available to IRE company taxpayers, not to an individual under IRP. The result is genuine, unrelieved double taxation on director's fees. Dutch income tax and Paraguayan tax both reach the same income and nothing offsets it.
- Significant issueLeaving home: exit tax and ties
The conserverende aanslag no longer lapses after 10 years, and Paraguay adds a security requirement on top
On emigration, a Dutch substantial-interest holder is treated as having disposed of the shares, and the resulting box 2 gain produces a conserverende aanslag. The old framing of this as a 10-year problem is obsolete, for deregistration after 15 September 2015, the deferral runs indefinitely and the possibility of remission after 10 years was abolished with retroactive effect, surviving only for pension and lijfrente conserverende aanslagen. Paraguay sits outside the EU and EEA, which changes the mechanics further, automatic deferral under the Invorderingswet only applies to emigration within the EU or EEA, so moving to Paraguay means deferral is granted only on request and only against sufficient security, a bank guarantee, a mortgage over immovable property, or a pledge of good-quality receivables. A Dutch founder with a EUR 2 million BV can face a box 2 conserverende aanslag of roughly EUR 600,000 at 2026 rates, and posting acceptable security to the Ontvanger is the real gate before any Paraguayan question even arises.
- Significant issueRight to work
Working for Paraguayan clients without authorization crosses the line
The one clear line Paraguay draws is local, Paraguayan-sourced activity: taking up employment with a Paraguayan employer, providing services to the Paraguayan market, or otherwise earning Paraguayan-source income without the right residency or work authorization. That is different from a foreign-paid laptop job, which the research found no clear prohibition on. Specific penalties for crossing this line were not confirmed from a reachable primary source.
- Significant issuePermanent establishment risk
Signing contracts or managing from Paraguay creates real permanent establishment risk
Article 5 of Ley 6380/2019 names branches and agencies, industrial facilities, natural-resource extraction, construction or assembly work over 12 months, and dependent agents who give operational instructions on behalf of a foreign entity, except for instructions limited to purchasing goods, as activities that create a permanent establishment. Habitually concluding contracts or exercising real management authority from Paraguay sits squarely inside the dependent-agent and management tests. A confirmed PE means Paraguayan corporate tax on attributable profits.
